Can a school legally take your cell phone and make you pay for it to be returned?
I never signed any school policy forms or any student handbook papers stating that i agree to the policy. Im not looking for an answer like a teacher would give me like dont take your phone to school or there would be no problem or dont have it out and there would be no problem. i want a legit answer, im all about my personal rights and i hate people taking them from me.

they have no right. however they do have the right to set conditions for attendance at the school. you are free to keep your phone but not attend the school. if your school has a well publicized system of fines for other misdemeanours then they may be within their rights to exact a small fine though a good lawyer could probably overturn it. is there a student council ? could you lobby to have the phone policy rescinded?
