No. The tenant is supposed to inspect the property and determine if its in a condition they can accept. If they find it acceptable, and choose to rent the property of their own free will, the landlord has not broken any laws. But if later the tenant is able to legally determine the property uninhabitable they can move without penalty (return of deposits). But again no law has been broken while they chose, of their own free will, to live there and pay rent.
You also need to remember you don't live in a vacuum where everything remains the same. Property needs maintenance on occasion so things that appear to not have problems one day may need repair the next.
